RPE FITNESS AGREEMENT TERMS AND CONDITIONS

 

1.       DEFINITION OF DUTIES

 

The Customer acknowledges and agrees that the terms under this Agreement are for Personal Training and Nutrition consulting services made available by the Provider.  The Provider is not responsible for Customer compliance with any program given, it is on the customer to show due diligence to complete the programs given. Results are not guaranteed.

 

 

2.       COMPENSATION

 

The Customer hereby retains the Provider and the Provider hereby agrees to provide Personal Training and Nutrition Consultation services for Customer according to the terms listed in the Agreement.

  

  

3.       PAYMENT FOR SERVICES

 

(1)        The Customer will pay for services provided under this Agreement by Pre- Authorised  Debit (PAD) from their financial institution. When initiating this service, the Customer will be charged a $20 set-up fee which will be included in the first PAD payment. If there is a break in time between agreements the set up fee will re-apply.

 

(2)        On the first and fifteenth day of every month thereafter, The Customers account will be debited for the bi-weekly payment for services according to the Provider’s published schedule. This Agreement is terminated on the last payment day stated on the PAD Agreement form. The Provider shall provide detailed invoices and shall maintain, and provide, upon request, back-up documentation for a period of one year from the date of the respective payments.

 

(3)        The Providers Personal Training and Nutritional Consultation Services are currently exempt from GST. If at a future date, the Provider is required to charge for GST at the current rate, the Customers bi-weekly payments will be adjusted accordingly to reflect this requirement until the completion of the Agreement.

 

(4)        If the customer wishes to cancel the PAD agreement, e.g. The customer is changing financial institutions then 30 days written notice is required. This RPE Fitness and Training agreement is still binding and will require a new PAD to be initiated or an alternative method of payment made available to complete the remainder of the agreement term.

 

 

4.       MISSED PAYMENT(S)

 

The Customer shall make payment for services on the first and Fifteenth of each month. Should the payment request be denied by the customers financial institution then the providers $25 NSF fee will also apply to the customers account. This will be added to the next PAD payment. (The customer will be notified of this, See article 7 on the PAD Agreement Terms and conditions)

 

 

5.       TERM

 

This Agreement shall commence on the date stated above, and shall remain in effect until all obligations under this Agreement have been properly completed. This Agreement may terminated if the Customer moves home away from the City of Winnipeg or if the the Customer sustains a serious injury that prevents them from continuing . This Agreement will not automatically renew and a new Agreement will need to be made upon the renewal of the providers services.

There are 2 fixed term agreements available.

3 month - This agreement is for a fixed 12 week period and will comprise of 6 equal bi-weekly payments.

12 month - This agreement is for a fixed 52 week period and will comprise of 26 equal bi-weekly payments.

 

6.      CANCELLATION POLICY.

There is 7 day cool off period, if the customer wishes to cancel the agreement, this can be done within 7 days of the Customer signing this Agreement. The Agreement will then be terminated, the 1st payment and set up fee will not be reimbursed to the Customer.

The Agreement may also be cancelled if the client moves away from the Winnipeg area or suffers from a serious illness or injury which prevents them from continuing an exercise program. ( This will be at the discretion of RPE Fitness).

 

7.     SUSPENSION POLICY.

  

The client may suspend only the 12 month agreement for one period of up to 4 weeks within the 12 month period. The suspended period of time will added on to the end of the agreement term and the payment term extended until the agreements completion. The 3 month agreement can not be suspended.
